Terms of Use

01Agreement

These Terms of Use are an agreement between you and OB DATA LLC (“Olune”, “we”, “us”), which operates the Olune app for iOS and Android and joinolune.com. They also serve as the end user license agreement (EULA) for the app. By using Olune you agree to these terms and to our Privacy Policy. If you do not agree, do not use Olune.

02Who can use Olune

You must be at least 13 years old, or the age of digital consent where you live if that is higher. If you are under 18, you may use Olune only with the permission of a parent or guardian, who agrees to these terms on your behalf. Do not use Olune if the law where you live does not allow it.

03What Olune does

Olune uses artificial intelligence to create images of you styled in looks you describe, from a photo you provide, and helps you find similar products sold by other companies. The images are AI-generated approximations for inspiration. They are not photographs of you wearing real garments, and color, fit, proportions and details can differ from reality and from any product. Product matches are suggestions, not guarantees.

We may change, add or remove features, and we may limit or suspend parts of the service to keep it running and safe.

04Your account

Olune creates an account for you automatically so your looks and settings can be saved. You can add an email address or use Sign in with Apple to keep your account across devices. Keep your sign-in details to yourself, give accurate information, and tell us at support@joinolune.com if you think someone else is using your account. You are responsible for activity on your account.

05Your photos and acceptable use

You keep ownership of the photos and text you provide (“your content”). You give us a worldwide, non-exclusive, royalty-free license to host, process, transmit and display your content only as needed to provide, secure and support Olune, including sending it to the providers listed in our Privacy Policy. This license ends when your content is deleted, except for copies we must keep by law.

When you use Olune, you agree that you will not:

• upload a photo of anyone but yourself to create looks, or a photo of any child;
• impersonate anyone, or create images meant to deceive people about who someone is or what they did;
• create sexual, nude, hateful, harassing, violent or otherwise unlawful content;
• upload content you do not have the right to use, or that infringes anyone’s rights;
• get around free or fair-use limits, including by creating multiple accounts, or interfere with, scrape, reverse engineer or overload the app or our servers, except where the law allows it;
• use Olune to build a competing product or dataset, or to train AI models.

We may remove content and suspend or close accounts that break these rules.

06AI-generated images

As between you and us, you own the images Olune generates for you (“output”), to the extent the law allows anyone to own them, and we assign to you any rights we have in your output. You may use your output for personal purposes, including sharing it. You are responsible for how you use it, and you must follow these terms and the law when you do, including not presenting it as a real photograph in a way that misleads people.

AI can produce similar output for different people, so output may not be unique and may not be protectable. Olune may add a small Olune mark to images you share on the free plan. We use output only to provide and support the service for you; we will not use your images in our marketing without your permission.

07@handles, names and inspiration

You can type the @handle of a public profile, a name, a brand or a place to describe a look. These are used only as style inspiration. The people, brands and places you mention are not affiliated with Olune and do not sponsor or endorse it, and the output is not made or approved by them. Do not use Olune to create images that suggest otherwise.

08Shopping, retailers and affiliate links

Olune does not sell products. Shop the look and Shop any photo show close matches offered by third-party retailers. Prices, availability, sizes, shipping, returns and the products themselves are the retailer’s responsibility, and any purchase is a contract between you and the retailer under its terms. We are not responsible for retailers or their websites.

Some store links are affiliate links, including through ShopMy, and links may pass through joinolune.com/go. If you buy after following one, we may earn a commission from the retailer or the affiliate network, at no extra cost to you. This does not change the price you pay.

09Olune Pro and billing

Olune is free to start, with a limited number of free looks. Olune Pro is an auto-renewing subscription that includes: unlimited styling, every style, every day; unlimited remixes, blends and accessory swaps; watermark-free shares; your whole feed styled on you, refresh anytime. Unlimited styling, subject to a daily fair-use limit. The daily limit is set to keep the service reliable for everyone, and we may adjust it.

Plans are weekly, monthly and annual. In the US they are $6.99 per week, $14.99 per month, $79.99 per year; the app shows the price in your currency before you buy. If a free trial is offered, the app shows its length first, and any unused part of a trial ends when you buy a subscription.

On the App Store (iPhone)

Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period, and your account is charged for renewal within the 24 hours before the period ends. Manage or cancel in Settings, then your name, then Subscriptions. Refunds are handled by Apple under its policies.

On Google Play (Android)

Olune Pro is not yet available on Android. When it is, payment will be charged to your Google Play account when you confirm the purchase. Subscriptions renew automatically until you cancel in Google Play: open your profile, then Payments and subscriptions, then Subscriptions. Cancel before the renewal date to avoid the next charge. Refunds are handled by Google under its policies.

Deleting the app or your Olune account does not cancel a subscription. If we change the price of a subscription, the store tells you in advance as its rules require, and you can cancel before the new price applies.

10Our rights and your license

Olune, its software, design, text, graphics and brand belong to us or our licensors. We give you a personal, revocable, non-exclusive, non-transferable license to install and use the app on devices you own or control, for personal, non-commercial use under these terms. You may not copy, modify, distribute, sell or rent the app, or remove any notices. If you send us feedback, we may use it without owing you anything.

11Additional terms for the iOS app

If you downloaded Olune from Apple’s App Store, these terms also apply, and they prevail where they differ:

1. Acknowledgement. These terms are between you and OB DATA LLC only, not Apple. OB DATA LLC, not Apple, is solely responsible for the app and its content.
2. Scope of license. Your license is limited to a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
3. Maintenance and support. OB DATA LLC is solely responsible for providing maintenance and support for the app, as described in these terms or as required by law. Apple has no obligation to provide any maintenance or support.
4. Warranty. OB DATA LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses from any failure to conform to a warranty are OB DATA LLC’s responsibility.
5. Product claims. OB DATA LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar laws.
6. Intellectual property. If a third party claims that the app or your possession and use of it infringes that third party’s intellectual property rights, OB DATA LLC, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
7. Legal compliance. You represent and warrant that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
8. Developer contact. Questions, complaints or claims about the app: OB DATA LLC, support@joinolune.com.
9. Third-party terms. You must comply with applicable third-party terms when using the app, such as your wireless data service agreement.
10. Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these terms, and on your acceptance of them Apple will have the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.

If you downloaded Olune from Google Play, Google is likewise not a party to these terms and is not responsible for the app; Google Play’s own terms also apply to your use of Google Play.

12Third-party services

Olune relies on third-party services, such as AI model providers and app stores, and links to retailers and other websites. Their services are governed by their own terms, and we are not responsible for them.

13Ending your use

You can stop using Olune and delete your account at any time in the app: Profile, then Account, then Delete my account. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering Olune, and we will tell you when we reasonably can. Sections that by their nature should survive, such as ownership, disclaimers, limits of liability and disputes, continue to apply.

14Disclaimers

Olune is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that Olune will be uninterrupted, error-free or that output will be accurate or meet your expectations. Olune gives style suggestions, not professional advice. Some places do not allow these exclusions, so they may not apply to you in full.

15Limits of liability

To the fullest extent the law allows, OB DATA LLC and its members, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of Olune. Our total liability for any claim relating to Olune is limited to the greater of the amount you paid us for Olune in the 12 months before the claim and US$50. Nothing in these terms limits liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence.

16Your responsibility to us

To the extent the law allows, you will defend and indemnify OB DATA LLC against claims, damages and costs, including reasonable legal fees, that arise from content you provide or from your breach of these terms.

17Governing law and disputes

These terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located there, and you and we consent to their jurisdiction.

If you are a consumer in the European Union, the United Kingdom or another country that gives you mandatory rights, you keep those rights, including the right to bring proceedings in the courts where you live. Before starting a formal dispute, please email support@joinolune.com so we can try to resolve it.

18Changes to these terms

We may update these terms. If a change is material, we will tell you in the app or by email before it takes effect. If you keep using Olune after that, you accept the updated terms; if you do not agree, stop using Olune and delete your account.

19General

These terms and the Privacy Policy are the entire agreement between you and us about Olune. If any part is found unenforceable, the rest stays in effect. If we do not enforce a right, we do not waive it. You may not transfer these terms; we may transfer them as part of a merger, acquisition or sale of assets.
